CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS. Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders
Pay half or the full amount of the order upfront once the invoice is sent
The product will be delivered digitally through email.
I will not be responsible for the loss of product once it has been delivered.
You can have five complete revisions in the sketching phase.
You can have 5 minor edits after completion (i.e. eyecolour change).
Must be paid in British pounds in PayPal / Kofi
You can't get refunds unless I'm unable to start it, or haven't finished the commission in 4 months.
Communication is important; if you ghost me for 2 weeks, I will cancel the commission.
If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.
I have full rights over their artwork, so I can use it however I see fit. (to see what customers' rights are in the full version)
Products cannot be used for commercial use without permission.
The seller can cancel and refund any order at any time.
The customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.
I have the right to reject any order that I do not feel comfortable drawing for any reason.
If you have a deadline, let me know.
Don't be mean, cuz if you are I will cancel if you are being an asshole.
Also, always ask if you have questions; I'll be happy to answer them.
Terms of service
This contract applies to the artist further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:COPYRIGHT / USAGE POLICY
I, Maryam Imran aka Lady Mari (The artist) , claim the rights to the produced drawing, not the buyer. Therefore, I am allowed to use the copyrighted artwork to:
- Promote myself with it everywhere.
- Publish books with it (artbooks, etc.)
- Display it everywhere to my liking (website, social media, etc.)
- Post it wherever I wantThe buyer (You) is allowed to:
- Use the commissioned piece for personal use unless agreed otherwise (you can upload it to all your social media profiles, forums, etc.) (you don’t have to credit me all the time, but I would appreciate it!)
- Print the artwork, but cannot sell the prints.
- Can claim the character(s) as their own, but not the artwork itself.
- Use the artwork to promote themselves. You are not forced to give me credit when you post it, but it is very appreciated.
- Use the artwork on their YouTube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.You cannot edit the artwork or sketches in any way.
You cannot remove any of the watermarks of the artist.
You cannot claim my art as your artwork.
You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me prior to paying for the artwork.
You do not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
In addition, you do not hold the right to use the product for AI datasets or AI tools and any present or future inventions in the space.PAYMENTS
Don’t send any money to me unless I have agreed to commission you and sent you an invoice.
You have to pay 50% or 100% of the total commission price mentioned in the invoice sent to the email provided by you. The payment must be provided within a week of receiving the invoice.
I will not start to work on the artwork until I have received 50% or 100% of the commission price.
The remaining total must be paid when the watermark final piece is provided. If payment is not provided, a watermarked piece will not be provided, and you will be blacklisted from being commissioned in the future and from art communities. Don't have the money? Don’t commission me.
You can only pay through PayPal/Kofi. Any other payment options should be discussed and agreed upon with me beforehand.REVISIONS
You have the right to 5 complete revisions in the sketching phase.
You have the right to a maximum of 5 minor edits after completion, such as changing an eyecolour or fixing a small detail. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.
If your reference is unclear to start with, changes will come at an extra charge.PROCESS
I have the right to reject any order that I do not feel comfortable drawing for any reason.
While I'm working on your commission, I will make reviews with you to make sure I make it just right for you!
During the reviews, you will see work-in-progress, and these images will usually include a watermark and be smaller than the finished piece.
The time it takes to finish your commission varies from 2 weeks to 2 months, depending on factors such as health, the complexity of the commissioned piece, other work, and conditions.
If you are on a deadline, please communicate that with me. If the deadline is less than 2 days, extra charges will be added.
If anything comes up that will slow the progress of the initially estimated delivery time, I will let you know asap.
Once the piece is finished, you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.ARTWORK DELIVERY
I will notify you when I have started on your commission, and you, therefore, lose the right to a refund.
You agree that the final artwork with no watermark will be delivered digitally to the email address provided by you on the form, after the full payment has been received by me.
It is your sole responsibility to propose an email that works for both parties. I cannot be held accountable for your loss of access to the delivery method, loss of delivered files, impediments such as spam filters, or any other technical obstacles outside my responsibility.
Upon delivery of the product, it is your responsibility to store it properly. Loss of product due to negligence will not be reimbursed by me. I can not guarantee that the original copy of the product will be available in the case that the Customer loses their files, but still email me in case I have it.CURRENCY CONVERSIONS
You have to pay the total amount specified in British pounds (GBP, £).
It is your sole responsibility to bear any currency conversion costs, bank transfer fees, payment provider service fees, and any other costs involved in transferring funds to the Seller.
Payment is considered as received and completed only when the total amount received on the Seller's account is equal to the invoice amount in British pounds.REFUND POLICY
You can not request a refund once I have started working on the artwork.
If, for any reason, I am unable to start your commission, you will receive a full refund.
You have the right to request a full refund if there has been no progress for two consecutive months, or when the Product has not been completed within four months.
You have to contact me in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc. Lack of timely communication on behalf of your part will be recognized as a cancellation of commission work. No refunds if the piece has been worked on.
If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.
If you request a PayPal chargeback at any point when you were not allowed to ask for a refund, you will lose all aforementioned rights to the commissioned piece, and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.CANCELLATIONS
I have the right to refuse or cancel any order, under the condition of a full refund, without giving reasons to you.
Any disrespectful behaviour will not be tolerated and may result in the cancellation of the order. You will receive a full or partial refund depending on the amount of work completed. I will have the full right to refuse any service to you in the future.If the buyer breaks any of the points stated above, they will lose all the aforementioned rights to the artwork commissioned by me, Maryam Imran, aka Lady mari (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.
